A car accident is perhaps the last thing that you think could ever happen to you. But regardless of how careful a drive you are, you do not know just when you might come across a reckless driver and get into an accident yourself. Knowledge about your rights and the motor vehicle accident law might come in handy should you or anyone you know meet a road accident.

The first thing you need to do in case you find yourself facing problems after a vehicular accident is to hire the services of a lawyer, who will readily help you with all you need to know about claims and other matters.

Road accident risks are the same no matter what type of vehicle you handle - a motorcycle, a truck, or your family car. Read on for an overview of motor vehicle accident laws, the most common causes of road accidents, and how they can be avoided.

This article’s list of top ten causes of auto accidents include: (1) Speeding, (2) Weather, (3) Drunk Driving, (4) Sleepiness, (5) Cell phone use, (6) Distractions, (7) Drug Use, (8) Recklessness, (9) Road problems, and (10) Rubbernecking. They come in no particular order and are taken from various sources.

Government officials and various organizations have been aiming to raise awareness to help prevent auto accidents. However, speeding continues to be a common problem on the roads. Different countries impose different speed limits but one universal rule is that, the faster you go, the higher the risk of sustaining an injury in case you meet an accident. Get legal representation right away if you become the victim of an accident. Hire the services of an 18 wheeler accident lawyer or a motorcycle accident lawyer, depending on what vehicle you were handling. They are experts on specific cases and could help you better with regards to settlements, making claims, and other matters.

The weather is the second top cause of vehicle accidents. Drivers have little control of rain, fog, and snow, which cause slippery roads and blurred vision. Be extra careful when driving in bad weather. Drunk driving and drug use are top causes of auto accidents. Alcohol and drugs slows down the body’s reflexes and makes a person more aggressive. For obvious reasons, drunk driving is prohibited by motor vehicle accident law.

The next top cause of road accidents is sleeping on the wheel. The National Traffic Safety Administration records some 100,000 accidents caused by sleepiness in the US every year. Cellular phones are hazards to road safety only if we allow them to be. Stop the car if you must make or receive a call. Do not rely on your handset’s hands-free feature. Aside from using cell phones, distractions like eating inside a vehicle, changing the radio station, and having kids or animals in the car are also major accident causes.

As for other auto accident causes, there is recklessness, which is the willful disregard for motor vehicle accident laws implemented by a state or country. Rubbernecking, on the other hand, is the occurrence of an accident in close proximity to another earlier accident. Drivers should always remember the basic rule: keep your eyes on the road. Poor maintenance of roads is also a major cause of accidents. It is up to motorists to be alert and extra careful.

Car accident laws are in place for a reason. Look for lawyers which specialize in your case. Hire the services of a motorcycle accident lawyer or a car accident lawyer, depending on what you are driving, with significant experience.

What to look for When Selecting a Personal Injury Attorney.

After being hurt in an accident one of the most intimidating tasks you face is choosing an lawyer to represent you. Accident victims are bombarded with television ads, billboards, yellow page ads, and in some instances, even direct mail advertisements. All of these ads have a few things in common. The attorney usually states they will “fight aggressively” for you, or that they’ve gotten their clients enormous settlements, and sometimes they even have flashy nicknames or catch phrases. Ignore the ads.

When looking for a personal injury lawyer the best way to ensure you are going to be getting good representation is to ask questions and watch out for red flags. The first red flag is whether or not you get to meet with an attorney for an initial consultation. Many firms tell you that the case is screened by a “case manager” or a “case specialist”, or sometimes even a paralegal. These firms will sometimes try to have you to sign up over the phone without even letting you talk to an attorney. They will send an “investigator” to bring papers for you to sign and will work hard to get you to sign up as quickly as possible. Ignore these firms. If the attorney will not even give you the courtesy of an initial consultation, imagine how much time the attorney will spend on the case. These firms generally assign huge numbers of cases to each attorney and consequently, the attorney’s cannot dedicate very much time to each case.

The next red flag is that the attorney tries to have you pay some up front costs or retainer. Unless you elect to pay the attorney hourly, personal injury attorney’s work on contingency, meaning that they are paid their fees out of the settlement or verdict. Sometimes, a lawyer will request you give them a certain amount of money to cover the costs of the case. This may be a red flag; in that it may indicate that the attorney doesn’t have enough capital to front the costs of the case, which brings me to my next topic: Ask questions.

It is important to be an advocate for yourself, and in being an advocate, you must ask questions. Ask the attorney how many cases each attorney handles at any given time. Make sure that you feel comfortable with the attorney handling that many other cases on top of yours. Also, ask the attorney if they will be personally handling your case, and if they will not, ask to meet the attorney who will be handling the case. Make sure that you are comfortable with that attorney. Ask how frequently you can expect to hear from the attorney, not the paralegal or case manager, but the attorney. Find out how much trial experience the attorney handling your case has, and more importantly, the percentage of cases that the firm files a lawsuit on. This is important because, while most cases settle before going to trial, it is imperative that insurance companies know the attorney is willing and capable of filing a lawsuit if necessary, it is the only way they are willing to offer top dollar on the case. Simply filing a lawsuit doesn’t mean that the case will go to trial. Finally, don’t limit your questions to the attorney. Ask around. Ask friends or family members who have used an attorney if they would recommend their attorney. If you know any attorneys ask them, or ask your doctor who they would recommend. The bottom line is that you must trust your lawyer, if at any point you don’t feel as though you are connecting with them move on.

Choosing an attorney is a decision that should not be taken lightly. It is good to visit a few before making your selection. Don’t be pressured into hiring a lawyer until you are confident you are selecting the attorney who will get you the best recovery and treat you respectfully throughout your case.

How to Beat a Colorado Drunk Driving Charge

Ok, so you’ve been issued a ticket in Colorado for Driving Under the Influence (DUI) or Driving While Ability Impaired (DWAI). Take a deep breath; its not the end of the world. In fact, there may be a way to beat your case entirely.

First, the police officer needs a valid reason to stop you or otherwise contact you in the first place. If they did not have a reason to contact you, their case won’t get very far. Police are not allowed to stop any car on the road, they must have reasonable suspicion to stop you.

It is also possible to get the chemical test thrown out of court. Then the prosecutor is left with no test results to use against you and a big hole in his evidence. Breathalyzers have a strict set of operation rules, and the operator of the Breathalyzer may invalidate the test by not following the rules. In addition, the Breathalyzer must be properly maintained and operating correctly.

Chemical tests of your blood also must follow the proper procedures for the test to be legally valid. In every case, you will want to retest the blood sample. In some cases, the retest result comes back under the legal limit or varies so much from the original test that the first test is deemed invalid.

Lack of jurisdiction is another way to beat your DUI case. Jurisdiction means the geographic area a police officer is allowed to patrol and conduct police activities. You should always check to verify that the police officer who ticketed you had jurisdiction where you were contacted. If he lacked jurisdiction, you may be able to beat your DUI.

In many instances, there are certain hearings like the DMV or other court hearings, where police officers need to be physically present to provide testimony in your case. In many cases, no officer means no DUI. Yes, it may seem like a strange technicality, but this strategy may be the right one in your case.

Now, how do you exploit these strategies? Hire a good, local DUI attorney. You are looking for someone who knows everything there is to know about these cases. You also want to hire someone who practices exclusively in the geographical area where you got your ticket. A local attorney knows the judges, prosecutors, juries, and, most importantly, the little tricks specific to that city to get you the best result possible.

Do not hire an attorney who is making promises or guarantees, as tempting as it may be. An attorney who has not yet seen the police reports or chemical tests, or even spoken with the prosecuting attorney has no way of knowing what will happen in your case. That person is just trying to get your money by telling you what you want to hear.

Last, but not least, make sure you have an attorney, even if you have to get the public defender. Do not try to represent yourself, or you will have a fool for a client.

Have you been accused of a crime? Many people who have been charged with a crime are left consideringwhat they should do, and what is going to happen to them. You may be concerned about how these charges will affect your life, your career, and your freedom. You need a skilled Colorado Springs lawyer who will fight for you rights and your freedom. Before you hire a Colorado Springs DUI lawyer do your research.

An End To Distracted Drivers Texting? Department Of Transportation Bans Texting For Truck & Bus Drivers

Truck and bus accidents often occur as a result of distracted drivers. One of the biggest culprits is the use of cell phones to text while the commercials drivers are on the road. The Department of Transportation is hoping their new law puts a dent in the number of distracted drivers on the road.

Just recently, the Department of Transportation put a new law in effect that bans commercial truck and commercial bus drivers from texting while they are driving. Any who are caught doing so will face possible civil or criminal fines. The fines can total up to $2,750.

The move is meant to cut down on the increasing amount of technology and gadgetry found in commercial trucks and buses. The technology has been found to be a distraction to the drivers and may lead to an increase in accidents. Besides increased use of cell phones for texting and talking, truckers increasingly use computers on their dash to talk with dispatchers. Use of the phones and computers remains frequent while driving. The new law attempts to stimy the use of texting while driving, but does not yet address the increased use of the on dash computers.

There was a recent research study that addressed the repercussions of texting while driving. It showed that on average, a driver had to take their eyes off the road for a total of five seconds while they were typing out a text. This contributed to the driver who is texting being twenty three times more likely to get into an accident than a driver tha wasn’t.

The law banning texting is a good first step in an effort to improve safety on the roads.

Distracted drivers can cause accidents that lead to the unfortunate injury of others on the road. While it is important that the government is taking steps towards making the roads safer, there are still situations where a distracted truck or bus driver causes an accident. If you have been the victim in such a situation, make sure you contact a personal injury lawyer to discuss your issue.

Being the victim of a truck or bus accident can be a stressful situation. It would be wise to to talk to NJ injury lawyers about your case. New Jersey injury lawyers can help you to you understand your rights and educate you about your situation.

Tips On Driving More Safely

This is not a driver’s education article, and we won’t be talking about parallel parking, turn signals, or changing lanes. Instead, this is to focus on drunk driving, and why taking even a drink or two can lead to disaster. Groups like Mothers Against Drunk Driving (MADD) have released much information about drinking and driving, but there is much more to be learned about how drinking affects driving skills.

Multitasking becomes more difficult with just one drink. This is not a skill that everybody can do well anyway, just imagine how much harder it will be if you have been drinking. It has been a subject of amusement on TV shows to portray a drunken person trying to multitask and getting all tied up. We cannot function in a normal way when influenced by alcohol and multitasking could be the first skill to be affected.

Even when you are not under the influence of alcohol you need to concentrate in order to drive. You must keep up a continuous watch on rearview mirrors, side mirrors or just out of the windshield. Even on remote country lanes, where there are not many drivers on the road, we still have to be alert and be aware of our surroundings, as animals could cross at anytime and present a danger. If our senses are impaired and we are unable to concentrate our driving will not be up to standard.

The road is a difficult place to drive even when sober, especially really busy roads. This is true because there are so many variables that can change at any given time. Other people are also driving vehicles, and we can’t always assume that we know what another driver is going to do in advance. The older lady in the car next to you may decide to change lanes at the last minute, or begin to brake half a mile before the stop sign. Other drivers are not always as careful as they should be, either. Drinking only makes reaction times slower. Instead of easily navigating traffic, we tend to react slowly, and can easily wind up in an accident.

These are just some things that make driving safely hard, especially after a couple of drinks. It just illustrates that drinking and driving is not a good idea. It is best to avoid it as this can be very dangerous. You may consider not drinking at all or arrange for a designated driver. As a last resort you can even sleep in your car if there is no way to get home. After all, surely the safety of others and yourself are worth the sacrifices.

Why You Should Not Mix Drinking And Driving

Ever since the invention of the automobile people have been drinking and driving. There are many people that think they can drive if they have only had a couple drinks but this is far from the truth. There is never an excuse for drinking and driving, no matter how little you had to drink.

When you take the risk and drive will drinking there are many things that may go wrong. You could end up spending the night in jail and having to pay a large fine for a DUI if you are caught driving drunk. Not to mention all of the people you are putting in danger. A DUI is the best case scenario because you could end up taking someone’s life.

You run the risk of losing a lot when you are drunk and driving. If you drive after you have been drinking you take the risk of killing yourself or someone else. You will go to jail if you wreck and the result is someone’s death. You absolutely can and more than likely will be arrested and charged with the crime of man slaughter if you kill someone will driving drunk.

Most people would have a hard time living with the fact that their bad choice caused someone to die. Of course going out and having a few drinks is perfectly fine as long as you do not drive after you drink. If you are planning to have a drink make sure you plan on a safe way to get home like a friend or taxi.

There is never a reason to drink and drive when a cab can get you there safely for only a few bucks. The few dollars you pay the cab driver to take you home could save someone’s life and it may even be yours. Never think that you can drive because you have only had one or two drinks. Many people have said that they can drive as well or better when they have been drinking but this is never true.

There is no one who can drive better while being drunk. When you and your friends go out drinking, be the responsible adult and suggest everyone take a taxi cab home. When leaving after a night out drinking ask the smart question of “what is the number for the cab”? Never ask who is sober enough to drive us home.

When you have had a couple or drinks you may not make the most rational decisions. This is why planning ahead is so important. If you plan for a cab to drive you to the club or bar then you will more than likely be taking a cab home. Ask a friend to drop you off if you plan to drink this way your car will not even be there for you to drive. This country also has a problem with teenagers driving drunk.

Set a good example for your teens and talk to them about drinking and driving. Make sure they know that drinking is harmful and that driving drunk could ruin their lives or get them killed. Too many teens have lost their lives due to drunk driving.

There are people who have heard of the saying that if you are fooled the first time that is on you. Then there is something about if you are fooled the second time, then it is on them. Consider speeding tickets to be like this. Having gone over the speed limit and getting a ticket once or twice happens to everyone, but the more times you are pulled over the more points you get that go on your record.

People wonder how fast they have to be going before they will get pulled over. For the most part, the rule of thumb is that if you are going five or more miles over the speed limit, then you will be pulled over. Some will give you leeway for one or two miles over the speed limit. The big place that you do not want to be caught speeding as the price is doubles is in a construction zone.

Some cities actually offer classes if you are going way too fast. They call this safe driving school. This is because when they give you one of those tickets, it stays on your record. This can raise your insurance. Too many of these can mean serious trouble as well.

You have to pay these tickets. Normally you can just pay the amount if there is nothing to argue. If you do have to argue though, then you have to appear in court. Normally, when you go to fight a ticket you will not win. There have been many people who tried.

Sure, there are people who tell you to fake cry. They say that this will get you out of a ticket. This is not true. They also say to give the excuse that there is an emergency. Again, depending on the officer, this will not work. You did the crime. That is what speedometers are for.

If you do not pay a ticket, you might be wondering what happens. This can be a very serious thing. If you do not pay it and you have too many out there, they can arrest you for not paying them. Think of not only how embarrassing that might be, but also how time consuming that would be as you have to make bail and all of that good stuff.

When you are stopped remember to stop right away. They can get you for trying to outrun the police if you do not stop. Make sure that you keep your hands on the wheel too. When they approach your window that is when you roll it down and show them your license, registration and proof of insurance. We hope this gives you a glimpse of speeding tickets at its best.
